Terms of Service

Welcome to PrepCheck. These Terms of Service ("Terms") constitute a legally binding agreement between you and Kristoffer Tosbakken ("we", "us", "our") regarding your use of the PrepCheck application and services.

1. Acceptance of Terms

By accessing, registering for, or using PrepCheck, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-app notification. Your continued use after changes constitutes acceptance of the modified Terms.

2. Description of Service

PrepCheck is a meal planning and inventory management application that allows you to:

• Plan meals and create meal schedules
• Track food inventory using manual entry or barcode scanning
• Log meal consumption and inventory usage
• Synchronize data across multiple devices (when signed in)
• Export and import your data

The Service is provided "as-is" and we reserve the right to modify, suspend, or discontinue any feature at any time without notice.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 13 years old to use PrepCheck. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use PrepCheck.

3.2 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• A secure password
• Acceptance of these Terms and our Privacy Policy

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

You may not share your account credentials or allow others to access your account. We are not liable for any loss or damage arising from your failure to protect your account.

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use PrepCheck only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any commercial purpose without our written consent
• Collect or harvest personal information of other users
• Impersonate any person or entity

4.2 Your Content

You retain all rights to the data you create in PrepCheck (meal plans, inventory, etc.). By using the Service, you grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy and legality of any content you input into PrepCheck.

5. Barcode Scanning and Product Information

5.1 No Guarantee of Accuracy

PrepCheck provides barcode scanning functionality that retrieves product information from third-party databases and user-contributed data. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY PRODUCT INFORMATION.

Product information may be:

• Outdated or incorrect
• Incomplete or missing
• Based on different product versions or regional variants
• Contributed by other users without verification

5.2 User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL PRODUCT INFORMATION, including but not limited to:

• Product names and descriptions
• Nutritional information
• Ingredient lists and allergen information
• Expiration dates
• Storage instructions

5.3 No Medical or Nutritional Advice

PrepCheck is a meal planning and inventory tracking tool. IT DOES NOT PROVIDE MEDICAL, NUTRITIONAL, OR DIETARY ADVICE. The Service is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always consult with qualified healthcare professionals, registered dietitians, or nutritionists for medical or dietary advice.

6. Intellectual Property Rights

6.1 Our Property

PrepCheck, including all software, designs, text, graphics, logos, and trademarks, is owned by Kristoffer Tosbakken and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute any part of PrepCheck
• Use our trademarks or branding without written permission
• Create derivative works based on PrepCheck

6.2 Your Data

You retain ownership of all data you input into PrepCheck. We do not claim ownership of your meal plans, inventory lists, or other personal content.

6.3 Shared Product Database

When you scan a barcode and add product information, you grant us and other PrepCheck users a non-exclusive, royalty-free license to use this generic product information (product name, barcode) to improve the Service for all users.

7. Premium Features and Payment

7.1 Future Premium Subscription

PrepCheck currently offers free access to all features. We may introduce premium subscription features in the future, which will be governed by additional terms provided at the time of purchase.

7.2 Payment Terms (When Applicable)

If you subscribe to premium features:

• You authorize us to charge your payment method for the subscription fee
• Subscriptions automatically renew unless cancelled before the renewal date
• Fees are non-refundable except as required by law
• We reserve the right to change subscription pricing with 30 days' notice

8. Service Availability and Modifications

8.1 Availability

We strive to make PrepCheck available 24/7, but we do not guarantee uninterrupted or error-free service. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions (Supabase, Netlify, etc.)
• Force majeure events

8.2 Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature or the entire Service
• Change pricing or introduce new fees (with advance notice)
• Impose usage limits or restrictions

We will provide reasonable notice for material changes that negatively affect your use of the Service.

9. Account Termination

9.1 Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion:

• Your personal data will be permanently deleted within 30 days
• You will lose access to all data and features
• This action cannot be undone

9.2 Our Right to Terminate

We reserve the right to suspend or terminate your account and access to PrepCheck at our discretion, without notice, if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent, illegal, or harmful activities
• Abuse the Service or other users
• Fail to pay subscription fees (if applicable)

Termination does not waive any rights or remedies available to us.

10. Disclaimers and Limitation of Liability

10.1 "AS-IS" Service

PREPCHECK IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of information
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding third-party product information or barcode data

10.2 No Liability for Product Information

WE ARE NOT LIABLE FOR:

• Inaccurate, incomplete, or outdated product information
• Allergic reactions or health issues resulting from reliance on product data
• Food safety issues or spoilage
• Nutritional deficiencies or dietary imbalances
• Any decisions you make based on information in PrepCheck

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRISTOFFER TOSBAKKEN AND PREPCHECK SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Damages arising from your use or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100 (WHICHEVER IS GREATER).

10.4 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kristoffer Tosbakken, PrepCheck, and our affiliates, officers, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or data
• Any decisions you make based on information in PrepCheck

12. Data Backup and Export

While we implement backup systems, YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUP of any important data. We recommend regularly exporting your data using the Export feature in Settings.

We are not liable for any data loss resulting from:

• Technical failures or outages
• Account deletion (intentional or accidental)
• Service discontinuation
• Force majeure events

13. Third-Party Services and Links

PrepCheck may integrate with or link to third-party services (barcode databases, payment processors, etc.). We are not responsible for:

• The availability, accuracy, or content of third-party services
• The privacy practices of third parties
• Any damages arising from your use of third-party services

Your use of third-party services is governed by their respective terms and privacy policies.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of PrepCheck shall be subject to the exclusive jurisdiction of the courts of Norway.

14.3 Informal Resolution

Before initiating formal legal proceedings, you agree to contact us at info@prepcheck.no to attempt to resolve the dispute informally.

15. EU Consumer Rights

If you are a consumer in the European Union, you have certain rights under EU consumer protection laws, including:

• Right of Withdrawal: 14-day cooling-off period for purchases (when premium features are introduced)
• Legal Guarantee: Services must be as described and fit for purpose
• Unfair Terms: Any unfair contract terms are not binding on consumers

These Terms do not limit your statutory rights under EU law.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely matches the intent of the original.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PrepCheck regarding your use of the Service, superseding any prior agreements.

18. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19. Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.
